NYC appeals ruling striking down ban

NEW YORK (AP) -- New York City is asking appeals judges to reinstate a ban on supersized sodas and other sugary drinks, which was struck down by a Manhattan judge the day before it was to go into effect.

The city had vowed an appeal and said Thursday that lawyers had filed it late Monday.

In his decision on March 11, State Supreme Court Justice Milton Tingling said the 16-ounce limit on sodas and other sweet drinks arbitrarily applies to only some sugary beverages and some places that sell them.

In addition, the judge said the Mayor Michael Bloomberg-appointed Board of Health intruded on the City Council's authority when it imposed the rule.

Boxer held on NYC airport gun charges

NEW YORK (AP) -- Boxer Robert Guerrero was arrested Thursday at New York's Kennedy Airport after police said he tried to bring a gun on a plane.

Queens District Attorney Richard Brown said Guerrero, 30, presented a locked gun box to a ticket agent during check-in.

The box contained an unloaded .40-caliber handgun and three unloaded magazines, Brown said. The gun was registered in California but was not legal to carry in New York, the district attorney's office said.

"I hope that Mr. Guerrero fights better than he thinks," Brown said in a statement. "For anyone who hasn't gotten the message, let me be crystal clear. You cannot bring an unlicensed weapon -- loaded or unloaded -- into this county or this city. And if you do, you will be arrested and face felony charges."

Guerrero was arraigned later Thursday on charges, including criminal possession of a firearm. He was released on his own recognizance and ordered to appear in court May 14.

He faces up to four years in prison if convicted.

Guerrero, of Gilroy, Calif., is the former featherweight champion and current WBC welterweight champion.
