Amsterdam woman ordered to register as sex offender

FONDA -- An Amsterdam woman was ordered in Montgomery County Court to register as a Level 1 sex offender Monday in a case where she and her reported boyfriend were accused of subjecting a minor victim to non-consensual sexual contact during a party at their apartment last year.

Jennifer N. Potter, 24, accepted a plea bargain in May and pleaded guilty to third-degree criminal sexual act. Her inclusion to the state sex offender registry was part of a September sentencing in which she was also ordered to serve six months in jail and 10 years of probation.

Potter was sentenced just two days after codefendant Joshua Mendez was cleared of charges in a jury trial. Potter has since filed an appeal in an attempt to withdraw her guilty plea.

Mendez was cleared of charges of third-degree criminal sexual act, and third-degree rape.

The pair was arrested in January after what police described as a lengthy investigation after the victim reported the incident.

According to the arrest report, the female victim told officers that while attending a party at 52 Bayard St., she was "subjected to non-consensual sexual contact by the male and female who lived at that address."

The couple also originally charged with unlawfully dealing with a child because they allegedly served alcohol to the minor victim.

In other court action:

* A Saratoga Springs man who's been wanted nearly five years was scooped up on a warrant and arraigned Monday.

Dean M. Fox, 37, never appeared to answer his May 2008 indictment. He was charged with third-degree grand larceny for allegedly charging $7,300 in unauthorized items to his Amsterdam Printing company credit card between October 2006 and February 2007.

Fox pleaded not guilty during his arraignment. Trial has been scheduled March 18.
