FONDA -- The state Secure Ammunition and Firearms Enforcement Act says gun owners have until May 15 to opt-out of the disclosure of their pistol license information, and Montgomery County has put the form on its website so residents can exercise that option.
Stacks of the forms have already been received by the office of Clerk Helen Bartone, she said Tuesday, encouraging residents to mail completed forms if they decide to opt out.
Under the law, any pistol permit application received by the county's licensing agency will become part of a new electronic gun database, and become subject to public disclosure, unless one completes and returns the opt-out form.
According to Gov. Andrew Cuomo's website, all pistol permit information held by the county is currently exempt from Freedom of Information Laws, and will be until May 15.
By that date, those who have submitted the form will remain exempt from the FOIL provisions, unless the licensing authority has refused to grant the exemption. Those wishing to apply for the exemption should do so by May 15 to avoid any disclosure.
The form may be filled out anytime, the site says. "However, after May 15, if you have not yet filed an exemption form, your information may be subject to release under FOIL."
To access the form, visit co.montgomery.ny.us. Completed forms can be mailed to the Montgomery County Clerk's Office, P.O. Box 1500, Room 114, Fonda, N.Y., 12068.
